Policy of the journal

The idea of creating such a publication has arisen in view of the fact that actual scientific and scientific-practical magazines in the jurisprudence are established by the power authorities, educational institutions, and only a small part by the organizations implementing practical activity. The Media widely covers the official position of the government for various contentious legal issues, but to a small extent other points of view. Publications of educational institutions have the club nature and to a small extent available to the public. Moreover, the policy of many well-known publishing houses provides commercial component in the legally oriented journals, which provides access to scientific articles on the paid basis only, and open access to scientific publications is carried out after a certain time - a year later.

Legal science is too deeply immersed in developing of concepts, new definitions, in the comparative analysis of the legal legacy of the Soviet period and the first decades of lawmaking in new Russia, bypassing the current problems in law enforcement.Magazines recommended by the Higher Attestation Commission of the Ministry of Education of Russia, for publication articles of candidates, doctoral students and post-graduate students who is collecting coveted number of publications related to the protection of theirs theses, form their editions primarily of the articles of candidates for a degree, the studied issues of which do not always meet the relevance and are of little practical significance.

The legislative bodies of Russia sometimes in a hurry, and sometimes for the sake of the political will of the leadership of the country adopt imperfect laws that undermine the authority of law and alienate the laws from the legal rules. Lack of regulation by the norms of law many issues of public-law relations, gaps in the existing legislation is not conducive to building a legal state and upbringing in civil society respect for the law. The legal situation in the Russian society is that between the authorities and society (including its individual representatives) there is a hard confrontation, instead of constructive cooperation.Moreover, the extreme manifestation of this opposition is a crime.

Scientific and practical magazine “The Topical Issues of Public Law” provides the possibility of scientific discussions on a variety of topical legal issues for representatives of the different procedural camps in administrative and legal disputes.The magazine serves as a bridge between science and practice, which allows you not only be aware of most problems in law-enforcement practice, but also lets to discuss them, suggest methods of solving these problems. By finding ways to solve practical problems, legal scholars can better influence the formation of law.

The magazine publishes articles free of charge and is not of a commercial nature. The only criterion for publication of a scientific article in the journal is relevance of the considered issues and compliance with the subject of the magazine.You cannot persuade the magazine staff to publish articles not bearing a new knowledge. The magazine is open to authors from all over the world, and censorship is carried out only within the enforcement of national legislation of Russia on Media.The magazine is aimed at enabling authors the possibility to publish their research, under the condition of their originality and undoubted novelty. The content of the magazine is completely independent of the power authorities, academic science and other persons, because it is not on the budget of these persons.

The frequency of the journal issue is aimed to ensure rapid publication of scientific works of authors what is problematic at low periodicity of publications on similar topics. The editorial staff is interested in the fastest familiarization of the reader with contemporary views of the authors on the pressing legal issues, their views on the legal reality, and the authors’ suggestions to resolving various issues. Of particular value to the magazine are works containing drafts of normative legal acts contributing to resolving legal problems. As well as publications the access to the magazine is free of charge. The magazine is classified as open access journal. A distinctive feature of the journal is the editorial work on the translation into English of authors’ articles and providing possibility for foreign readers to be acquainted not only with the metadata of scientific articles in English, but also with the content of the article itself.

We very much hope that scientific and practical magazine “The Topical Issues of Public Law” in the course of time will contribute to the development of sectors of public law, but before that time will be available podium for young scientists and practicing legal scholars.

 

Publication ethics

 

Editorial review board, editorial staff and the publisher of the magazine undertake to assist the scientific community in all aspects of exercising the policy for compliance with the publishing ethics, especially in cases of suspected duplicate article submission or plagiarism.

 

In order to comply with the publication ethics the editorial staff of the magazine “The Topical Issues of Public Law” is governed by the provisions adopted at the 2nd World Conference on Research Integrity (Singapore, July 22-24, 2010), the provisions established by the Committee on Publication Ethics (COPE) and regulations of the Civil Code of the Russian Federation (Chapter 70 “Copyright”).

Editorial staff guarantees consideration of all submitted materials, respect for the Editors’ independence and integrity in decision-making without any prejudice towards authors because of national or religious background or position, regardless of commercial interests and relations with magazine’s publishers and owners, and basing on respect for authors’ personal rights and intellectual property right.

 

Editorial staff seeks to ensure and improve the quality of published materials, make a significant contribution to the development of domestic and foreign legal science; takes all measures to strengthen the quality of the published materials; strives to meet the needs of readers and authors through free access to the journal.

 

Relevance, authenticity, clarity and soundness of the published research material are set as guiding principles of editorial activity.

 

Among the main principles of high qualification of published research materials are: soundness, honesty, unambiguousness, completeness of provided materials, balanced approach, originality and transparency of scientific articles.

 

Editorial staff pursues the magazine’s policy for inclusion in the composition of the editorial board of qualified members actively promoting the development of the magazine.

 

Editorial staff guarantees measures for compliance published materials with copyright and publication ethics, screens published papers for plagiarism, duplicate or redundant publication (with help of appropriate software).

 

Editorial staff makes the final decision on acceptance or non-acceptance of a paper for publication basing on all received comments of independent peer reviewers. The final editorial decision and its reasons shall be communicated to the authors.

 

Scientific paper peer review ethics

 

Editorial staff guarantees independent peer review conducted by the method that ensures honesty and objectivity of comment on the scientific value of a paper considered for publication.

 

Editorial staff ensures fair and proper process of independent peer review.Editorial staff uses the services of independent peer reviewers in respect of papers that are considered for publication by selecting people with sufficient experience in the area of scientific interests, which are covered by paper, and avoiding those with conflicts of interest.

 

If serious concerns are raised by reviewers about the reliability of data or appropriateness of publishing scientific work, editors allow authors to respond to the concerns. Editorial staff protects the confidentiality of authors’ materials and reminds the reviewers to do so as well. Editorial staff should not give any indication of a paper’s status with the journal to anyone other than the authors. Editorial staff maintains the confidentiality of peer reviewers’ personal data.

 

Editorial staff reserves the right to reject a paper without peer review when it is deemed of poor quality or unsuitable for the journal’s readers. This decision should be made in a fair and unbiased way with taking into account the editorial policy of the magazine.

 

Scientific paper editing ethics

 

Editorial staff makes a decision on the acceptance or rejection of the publications, which makes it very important that this process is as fair and unbiased as possible, and is in accordance with the academic vision of the magazine.

Editorial staff shall respond to all statements about or suspicion of misconduct with regard to research or publication emanating from readers, reviewers, or other editors.

 

Editors work in accordance to the system of identity ensurance. Editorial staff receives information on identified problems and makes decision on paper’s acceptance for publication or denial of its publication.

 

Editor’s conflicts of interests shall be publicly declared. Editors should not be involved in decisions on papers in respect of which they have a conflict of interest.
